Robotech RPG Tactics, Better Business Bureau Part I

Nothing better than spending the day with friends and family. That was how I spent most of my day. A truly enjoyable, loud, and raucous lunch at Wendy’s. Thankfully, none of the people involved have any sense of public decorum, at least in regards to laughing out loud at a good story told with hand gestures, sound effects, and dancing by our boy. Holy crap, when he gets on a roll, there is nothing stopping him or his story…“Anyways, like I was saying…”

When I was waiting for us to arrive at a different place I was reading. What was I reading? I was reading the three responses to Better Business Complaints from Palladium Books. Now, before I get into what I read, allow me to say that there will be a follow up post or two as I have to gather some additional information.

Better Business Bureau For Beginners

For those who do not know this is what the Better Business Bureau is all about;

I feel that people should know what the Better Business Bureau is before getting into the responses.

Three Responses, One Message

As I stated above, I read three responses from Palladium Books, Kevin Siembiedia himself by the signature. Each response address the complaint by denying that Palladium Books should offer a refund and then lays out why the request for a refund should be denied. Allow me to state this upfront, I was surprised at how form-letter each of the responses were, entire paragraphs other than a name or number were identical.

“…This entitles him to certain pre-determined rewards when the project is finished. We have kept all of our Kickstarter backers informed as to the progress of this project, which has suffered a number of delays from our original expectations. That said, there has never been an exact release date (that’s not how Kickstarter works; you back a project, not purchase a product), and we have never stopped working to achieve the goals of said Kickstarter funded project.”

That is how each letter starts, a sentence identifying who he is responding to and then a follow-up with;

“As [insertname] should know, Kickstarter projects often deliver promised rewards well after their initial estimated dates. Under the terms of Kickstarter, as long as we are actively making this project (which, we are; Wave One items have already been delivered, and Wave Two is under active development), and communicating with the backers to let them know where things stand (we have posted 14 to 17 * Updates in the last six months, in addition to our own weekly e-mailings, which often include Kickstarter updates), we are in FULL COMPLIANCE with the Kickstarter rules.”

A Break For My Thoughts

Here is my issue with the opening of their response:

  1. If Palladium Books has kept everyone informed to the progress of the project, how come none of us have any information about the status of Wave 2? July 10 there was talk of providing a detail breakdown of everything. Today is August 21st and no breakdown. That alone refutes the assentation of keeping everyone informed.
  2. I have a serious issue with “As [insertname] should know…estimated dates,” where is this stated? Is this common knowledge? I ask, because used as part of defense the information must be common knowledge or stated, it is not. I did not know that Kickstarters are often late. Had I known, had that been common knowledge, I would never get involved. Thus, is this actually part of the process or an assumption or inference…only one of those applies as a valid defense.
  3. The statement that Palladium Books is making progress, is just that a statement. There is no verifiable PROOF that progress has been made on any part of Wave 2. There is PROOF that non-Wave 2 materials was made, the convention exclusives…well get into that in the next post.

Here is where I am going to end Part 1. If you noticed above there was an *: 14 to 17 updates…the content of the 14 to 17 updates (number varies due to date of response) is used as evidence of a lot of things. I will be going through 17 of them and providing details about what they were about for Part II.
